What the news says is that the FBI will have the possibility to record conversations remotely from a mobile phone when it's not even making calls or more interesting that the phone can even be switched off. It was called a roving bug, the phone might be remotely hacked to turn its microphone on and send audio data directly to the FBI. Without any mentions about any model numbers or carriers.
U.S. District Court Judge Lewis Kaplan announced that: “The device functioned whether the phone was powered on or off, intercepting conversations within its range wherever it happened to be."
